Rowsmith: Terms of Sale (paid plans) Version 2026-10-20. S1. Who sells, who provides. Paid plans are sold by Polar Software, Inc. (Dover, Delaware, US) as merchant of record. Polar takes your payment, charges any sales tax or VAT, issues your invoice and handles card disputes under its Checkout Buyer Terms (polar.sh/legal/checkout-buyer-terms). The service itself is provided and licensed to you by Mei Okubo, 1507 California St, San Francisco, 94109, California, US ("we"); Rowsmith is the name of the product and service. Where these terms and Polar's buyer terms differ, Polar's govern payment, tax, invoicing and disputes; these govern the service. Our Terms of Use continue to apply to everything these terms do not cover. S2. What you buy. A plan gives you one API key, with higher limits, for the period you pay for: Pro: 5,000 calls per day, up to 5,000 rows and 75,000 cost units per call, datasets up to 20,000 rows. Team: 50,000 calls per day, up to 10,000 rows and 150,000 cost units per call, datasets up to 50,000 rows. You can rotate your key at any time in Polar's customer portal. Paid plans raise limits only: for the same request, every plan returns the same data. The free tier stays available. Nothing else is sold: no professional service, advice or custom work. S3. Price, renewal, cancellation. Prices are shown at checkout in US dollars, plus or including tax as Polar shows. Your plan renews automatically each month or year, at the price shown at checkout, until you cancel. You can cancel at any time from Polar's customer portal (https://polar.sh/meiorz-tech/portal) or by email to the contact below; cancelling is as easy as subscribing. Cancellation takes effect at the end of the period already paid, and you keep the plan until then. After purchase Polar emails you a receipt that repeats these terms and how to cancel. S4. Refunds. Within 14 days of the first payment of a new subscription you can ask for a full refund, for any reason, by email to the contact below; Polar refunds it to the original payment method. Renewal payments are not refunded for periods already elapsed, except that if the paid limits were unavailable for more than 24 hours in total in a month, you can claim a pro-rata credit by email within 30 days. If you are a consumer in the EU, EEA or UK you also have a statutory right to withdraw within 14 days; our 14-day refund covers it, and you may use the service immediately in the meantime. To withdraw you can use this form: "I withdraw from my Rowsmith subscription; name; email; date." Statutory rights you have where you live are not affected. S5. Service level. We aim to keep the service available and do not guarantee it. The only remedy for unavailability is the credit in S4. S6. What the output is. The output is generated test data for testing and development, as the Terms of Use say (sections 3 and 6). It is not fit for production use or for decisions about people. S7. Liability. To the extent the law allows, our total liability under a plan is limited to the amount you paid for it in the 12 months before the claim, and we are not liable for indirect or consequential loss, lost profits or lost data. This does not limit liability for fraud, gross negligence or wilful misconduct, for death or personal injury caused by negligence, or any liability that cannot be limited by law. If you are a consumer, nothing here limits the rights you have under the law of your country of residence. S8. Changes. We may change prices or plans for future periods with 30 days' notice by email; the change applies from your next renewal and you can cancel before it. We may withdraw a plan; if we do, we refund the unused part of the period. S9. Keys, teams, sanctions, termination. Your API key is confidential and tied to you; you answer for every call made with it. On a Team plan the buyer answers for its members. We do not activate a key whose billing address is in a country or region under comprehensive US sanctions, and we stop a key whose billing address moves there. The order is refused and the payment is returned or held as sanctions law requires; where the law allows a return, we refund the payment in full if the key was never activated, and the unused part of the period otherwise. We may suspend a key that breaks section 4 of the Terms of Use and, if we end a plan for any other reason, we refund the unused part. You must be 18 or older, or buying for a business you are authorised to bind. S10. Law and contact. These terms are governed by the laws of the State of California, United States, and disputes go to the state or federal courts in California; either of us may use small claims court. Contact: business@meiorz.tech, or the mailing address in S1. We email you only about your plan and the service.
